Are Tired Drivers Criminal?

The Crown is appealling the aquittal of a Montreal woman who killed a young mother of two.  The allegation was that she was driving her SUV while fatigued.  Apparently at the scene of the incident she reported to ambulance drivers that she had been too tired to drive.  The judge refused to consider the “admission” on the basis that the driver was shocked at the scene.

The husband of the victim, now the single father of three young girls, is urging the creation of a specific offence making it illegal to knowlingly drive while sleep deprived.  However, experts have responded that the law adequately addresses this issue with the offences of dangerous driving or criminal negligence.
