Juror Excused from Court Due to Bad Body Odour

A Massachusetts Superior Court Judge dismissed a juror based on body odour.   The Judge felt that the stench would distract the other jurors.

The accused was ultimately convicted of a second degree murder.  The accused appealed on the basis that he was not given a fair trial due to the dismissal of the juror.  His conviction was affirmed by the state Appeals Court. The Court held that dismissing a juror because of body odour is acceptable.

Nine Months Jail for Ontario Drunk Driver

A 21 year old Ontario man received a 9-month jail sentence, a ten year driving prohibition and 2 years probation for impaired driving.

He was charged following an alcohol-related crash that left his passenger, his then girlfriend, with serious brain injuries.

The Ontario Court of Justice judge commented that the driver must have been living in a cave for the past twenty years not to realize the dangers of drinking and driving.

His blood-alcohol content was more than double the legal limit of .08.  Speed was also a factor.
